As you can see, our mission is to make workplaces healthier; to reduce stress, improve nutrition habits, and help employees to thrive.

We value your trust. Our contact form asks for your name, email and phone number. We also ask whether you would like to be put on our mailing list or be sent a brochure. If you choose to leave your phone number, we might call to say hello and share some of the exciting health promotion initiatives and offers we have to keep your workplace alive and vibrant. We use the information you give us, solely for The Vitality Agency's marketing purposes – which is usually a newsletter, sent out about three times a week, on lots of great ways to keep employees and workplace culture thriving; and that is it. You can choose to receive our updates on a daily, weekly or monthly basis. We don't sell, rent or trade your information to other companies or businesses.

The Vitality Agency Ltd & The Vitality Agency Incorporated recognizes the need to protect the privacy of the personal information you provide to us with respect to the details you enter in our contact form.

Therefore, we have created this privacy policy, which lets you know, amongst other things, the type of information collected, the purpose and use of the collected information, and your rights with regard to the collected information. This Privacy Policy governs how we use your personal information.

 

Protection of Your Information

The information we collect currently gets updated to our Mailchimp database where it is stored for when we send our newsletters.

 

Type and Purpose of Collection

We collect information at various points to improve the experience of our customers. Specifically, two types of information are collected:

  1. Non-Personal Information: Upon accessing the our website, certain non-personal information will be automatically collected, such as your IP address, location data (which is anonymous and where you log in through the website you will be asked if you consent to the Applications accessing your location, which can be updated at any time in your device settings) and the referring website (“Non-Personal Information”). We are currently not using or analyzing this “non-personal information”. However, this situation is subject to change, as we grow and build up a tech department. This information does not allow you to be personally identifiable.

  2. Identifying Personal Information: To provide an effective service, we would need you to provide personal information that will allow you to be identified (Personal Information). This type of information will not be collected without your consent. The purposes of the collection of Personal Information are the following:

    1. To add you to our mailing list

    2. To send out our brochure

    3. To fulfill your order;

    4. To send you an order confirmation;

    5. To send you our newsletter provided you have not unsubscribed. You may opt out of such newsletter through using the unsubscribe link or by contacting us at hello@thevitalityagency.com

    6. To strengthen our connection with you, find out your needs and provide solutions to keep your workplace healthy.

We sincerely express that your Personal Information will not be used for any other purposes other than for marketing The Vitality Agency's services, and upholding our service commitment to our customers. The Personal Information we collect are i) name ii) email address iii) phone number. 

 

Right to Examine Information

You have the right to examine any of your Personal Information that we collect. Should you wish to examine such information, please send us a written request to hello@thevitalityagency.com. We reserve the right to charge you a reasonable administrative fee to access your information, as permitted by applicable law.

 

Withdrawal of Consent

You may withdraw your consent to the use of your personal information via our mailing lists and newsletter, by simple tapping the unsubscribe link at the bottom of our newsletters.

 

Sharing Information

We will not sell, rent or disclose to outside parties the information we collect and save. If there are instances that information might be shared, it would be in the following instances.

 

  1. Where required by law: We may share the collected information where required by law, specifically in response to a demand from government authorities where such demand meets the legal requirements.

  2. Statistical Analysis: We may share Non-Personal Information with third parties, including but not limited to for advertising or marketing purposes. No Personal Information will be shared in this manner.

  3. The Vitality Agency offices and operations: We may share Personal Information and Non-Personal Information with our group companies or with our offices and operations based outside your local country in order to provide you with our services and for our own operational processes.

 

International Transfer

Both Personal Information and Non-Personal Information you submit via the online contact form will be processed in Canada and the USA and stored on our MailChimp mailing list. This is storacy facility is subject to change as we are looking to introduce a new CRM system to our operations. Upon this change in operations, this privacy policy will be duly updated. Such information may also be transferred by us to our worldwide offices mentioned in the circumstances (see Section 5 above). This will be most likely for companies and clients that are using our services for their global wellness strategy. The countries concerned may not have similar data protection laws to your country. Where we transfer your information out of your jurisdiction we will take reasonable steps to ensure that your privacy rights continue to be protected. By sharing your email address with us, you agree to this storing, processing and transfer.

 

Payment processing

When you become a customer and choose to pay by credit card, an associate of The Vitality Agency contacts you by phone to get necessary details. Once payments are processed, these details are discarded, and an associate will be in touch again when you re-order. This is currently our process for credit card payments, which is subject to change, when our systems get updated. In the event of our payment processing systems being updated, a new privacy policy will come into effect.

Our payment gateway provider is WorldPay, which operates a secure server to process payment details, encrypting your credit/debit card information and authorising payment.

 

Terms of Service

This Privacy Policy is incorporated into and forms part of the Terms of Service, which upon becoming a customer, outlines the terms and conditions of our commitment to your organization's health and happiness.

 

Persons Under 18

Our service is currently not marketed to persons under 18. This is subject to change as we expand and grow. Should there be a change in these circumstances, this privacy policy will be duly updated.

 

Cookies and similar technologies

The Vitality Agency currently does not use cookies as part of our user experience. However, we are growing in our use of technology, and this is subject to change. When these changes occur, this privacy policy will be duly updated.
